By sending your order, you declare that you are familiar with and accept the general terms and conditions of the FitPanther.bg website and the company “Pantera 83” Ltd.

This electronic document contains General Terms and Conditions of Use, which apply to all transactions concluded remotely and govern the terms of purchase and sale through the website, with an integrated electronic store – Fitpanther.bg.

The owner of the website, with an integrated electronic store, FitPanther.bg is the company “PANTERA 83” EOOD (hereinafter referred to as the “MERCHANT”), entered in the Commercial Register at the Registry Agency with UIC 204186643.

These terms and conditions constitute a distance purchase and sale contract between “PANTERA 83” EOOD and any individual visitor to the site who has placed an order for the purchase of food through the electronic store.

In order to be able to maintain quality services that meet the wishes of its customers, “PANTERA 83” EOOD creates the General Terms and Conditions set out below in order to protect both itself and its customers from abuse.

p2. General Terms

By placing an order for MENUS / PRODUCTS from the e-shop on the Fitpanther.bg website, each CLIENT on the site agrees to these GENERAL TERMS OF USE and is obliged to comply with them.

CLIENT – is any person aged 18 or over, a visitor to the site with the FitPanther.bg e-shop, who has placed an order by clicking the “Order” button, available in the virtual cart.

The order made by the client has the force of a distance contract between him and the e-shop under the Consumer Protection Act.

MENUS / PRODUCTS – are the products offered in the e-shop.

MERCHANT – is “PANTHERA 83” EOOD

• ITEMS AND PRICES – all prices of the MENUS in the e-shop are in Bulgarian leva.
• The published prices of items are final and include all taxes and fees.
• The prices indicated are for one item and do NOT include the cost of delivery of the GOODS.
• The main composition of the MENUS is listed on the presentation page of each product.
• The prices published in the online store at the time of sending the order request to Fit Panther Kitchen are valid.

The MERCHANT has the right to change the prices or characteristics of the PRODUCTS offered in the online store without prior notice. The CUSTOMER is obliged to pay the price that was current at the time of sending the order and confirming it.

The MERCHANT reserves the right to cancel orders for products displayed on the site due to a technical error or due to technical errors with clearly incorrect prices.

The MERCHANT does not guarantee the availability of the ordered PRODUCTS. In the event of unavailability of the requested PRODUCTS, the MERCHANT shall notify the CUSTOMER of the exhaustion.

The MERCHANT does not guarantee that access to the e-shop will be uninterrupted, timely, secure. The MERCHANT is not responsible for not providing access to the e-shop, as well as for not processing or untimely processing of purchase requests, in the event of circumstances beyond its control – cases of force majeure, random events, problems in the Internet network, hosting provider, etc.

All PRODUCTS, including those on sale/promotion, are sold and delivered while supplies last, even if this is not explicitly stated on the FitPanther.bg website.

When paying for the GOODS by bank transfer, the MERCHANT does not bear any responsibility for any costs related to fees, commissions or other additional payments made by the CUSTOMER or his bank in connection with the transaction itself. The costs related to such payments are solely at the expense of the CUSTOMER.

The MERCHANT undertakes to keep and NOT provide the personal data specified by the users to third parties.

These General Terms and Conditions may be changed unilaterally by the company “Pantera 83” EOOD by publishing an updated version of this document on the site. Before completing each specific order, the system will request your explicit confirmation that you are familiar with and accept the current version of these General Terms and Conditions.

p3. Requests / Orders

FOOD ORDER REQUESTS (PURCHASE OF GOODS) FROM THE ELECTRONIC SYSTEM OF THE SITE www.fitpanther.bg

Before completing each specific order, the system will request your explicit confirmation that you are familiar with and accept the current version of these General Terms and Conditions.

By clicking the “Order” button, the client declares that he has familiarised himself with these GENERAL TERMS AND CONDITIONS OF USE, accepts them, agrees with them and undertakes to comply with them.

THE MERCHANT confirms the accepted order of the CLIENT via e-mail (e-mail), electronic message on a durable medium and/or telephone call.

In case of incomplete, incorrect or erroneous data provided by the CLIENT such as address, telephone number, etc. – the order is considered invalid and will not be fulfilled.

Registration on the site:

To order the items published in the online store, you do NOT need to have a profile registration on the FitPanther.bg site. Registration is voluntary and free. It will make it easier for you in the future if you regularly order from our online storefront with menus.

Registration can be done either during the order or from the main menu, section “My Profile”, top left, by filling in the data specified in the registration form. Required fields marked with an asterisk (*) require data, without which it is not possible for us to fulfill your orders. When creating an account, you confirm that you are 18 years of age or older.

p4. Payment & Prices

The CUSTOMER pays for the ordered products in the online store at www.fitpanther.bg, using one of the following payment methods:

1. By card through the virtual POS terminal on the FitPanther.bg website
2. By card on site in the kitchen through a physical POS terminal.
3. By card upon delivery to a physical POS terminal provided by the driver.
4. By bank transfer.
5. By cash on delivery to the driver or in the kitchen on site.

All prices on the site are in EURO, for one product and are final, including VAT.

p5. Order Fulfillment & Delivery of Goods

The MERCHANT undertakes to deliver the ordered and purchased GOODS himself to the address specified by the CUSTOMER. THE GOODS (MENUS) are delivered appropriately packaged in tightly closed boxes, protected in a paper eco bag, with a set of cutlery and napkins – ready for consumption.

THE GOODS are handed over to the CUSTOMER or to a third party who accepts and confirms their receipt on behalf of the CUSTOMER. When the CUSTOMER is not found within the delivery period at the address specified by him or access and conditions for the delivery of the GOODS are not provided within this period, the MERCHANT is released from his obligation to deliver the GOODS requested for purchase. The CUSTOMER may confirm his desire to receive the GOODS even after the expiry of the delivery period in which he was not found at the address, assuming all costs of re-delivery.

Deliveries to the city of Sofia:

Delivery price – 4.00 BGN per day.
It is possible that the delivery price may reach 5.00 BGN for some more remote areas of the city of Sofia, of which you will be notified in a timely manner.

• We deliver for tomorrow for orders placed by 2:00 PM. Then for the next day.
• The delivery of each order is from 7:00 AM to 2:00 PM. In most cases, all orders are fulfilled by 12:00 PM.
• The kitchen is located in the city of Sofia, Manastirski Livadi – West district, under the Boyana district.
• The exact delivery time is determined according to your location.
  For example:
  If you are close to us as a location, your delivery will be early – before 9:00 AM.
  If you are in a more remote neighbourhood of the capital, such as Nadezhda or Lyulin, we deliver after 11:00 AM.
  For residents of the Center, delivery is between 9:00 / 10:00 and 11:00 AM.
• Sunday is a day off.
• Food for Saturday is ordered on Thursday and delivered on Friday by 2:00 PM.
• Orders for Monday can be made no later than 12:00 PM on Sunday.
• When delivering an all-day menu with breakfast after 10:00 AM, the first breakfast is saved for the next day.

Menus are delivered in completely paper packaging and (100% Compostable) Bio-degradable cups made from Plants + glass bottles.

Deliveries to Bulgaria outside Sofia:

Delivery to other cities starts from Tuesday to Friday, and on Friday, we deliver 2 menus, one of which is for Saturday:

• Days off are Sunday and Monday.
• Delivery is made by the courier company Econt to an address or an Econt office.
• Menus are delivered in specially insulated boxes with coolers.
• Delivery to an Econt office is 3.00 BGN per day up to 2 kg. (one menu).
• The parcel can be picked up from the office at the earliest at 9:00 am.
• Delivery to an address is 9.00 BGN, with a fixed time of your choice.
  – example: (delivery can be by 10:00 or by 11:00 at the address).
• Without a fixed time, the delivery price to an address is 6.00 BGN.
• Orders are placed the previous day by 2:00 pm.
  – example: if you order on Monday by 2:00 pm, the menu will be delivered to you on Tuesday by a certain time or at a given time.
• Econt office by 9:00 am.

Menus are delivered in all-paper packaging and (100% Compostable) Bio-degradable cups made from Plants + glass bottles.

p6. Right to Exchange or Return the Goods

The customer has the right to exchange or return the goods (food) only at the moment of its personal acceptance by the courier in case of any discrepancy with the order. All deliveries of ordered food from Fit Panther® have a preview option.

7. Duration of the Distance Contract

The distance contract between the MERCHANT and the CUSTOMER is considered concluded from the moment of sending the order, in the store section of the website www.fitpanther.bg, and is valid until the moment of delivery and acceptance of the order (food) by the CUSTOMER at the address specified by him in the order.

The distance contract is considered concluded after the review option and acceptance of the order (food) by the customer, at the moment of delivery.

p9. Copyright

The digital materials and assets of the website, with an electronic store part – www.fitpanther.bg and the trademark Fit Panther™, including logos, trade symbols, graphic images and inscriptions, texts and multimedia content, are subject to copyright within the meaning of the Copyright and Related Rights Act and are the property of “PANTERA 83” EOOD and its partners who provided the relevant information. Any unauthorised use may be a violation of copyright, trademark rights or other legal provisions.

“PANTERA 83” EOOD grants you the right to download and view all materials published on this site, for personal, non-commercial use only, provided that you comply with and comply with all copyright and relevant notices. It is not permitted to copy, distribute, publish or modify the materials from the website, with an electronic store www.fitpanther.bg.

p10. Rights & Obligations Under the Consumer Protection Law

“PANTERA 83” EOOD reserves the right to change the terms and conditions at any time, without prior notice, and the changed terms and conditions will be published on the website, with an electronic store fitpanther.bg.

Changes to the General Terms and Conditions of Use of the site do not affect the relationship between the customer and the merchant arising in connection with validly submitted requests for the purchase of goods (food orders) before the changes.
